Terms and Conditions

General Terms and Conditions for the use of the ticketing system for VieVinum HOFBURG Vienna. Customers who use the home ticketing system of MAC-Hoffmann & Co GmbH agree to the following terms and conditions in the version applicable at the time of use:

1. Subject Matter and Scope of Application

The following General Terms and Conditions apply exclusively to all contracts and orders relating to online tickets and the use of the ADITUS GmbH home ticketing system. These general terms and conditions form an integral part of the contracts concluded in the ADITUS GmbH home ticketing system, and no guarantee is given for the accuracy of the data contained in the ADITUS GmbH online presence. Information is subject to change at any time and without prior notice. The exhibition regulations of ADITUS GmbH and the house rules of the event venue must be observed when entering the event. Home tickets may be purchased only from the official website.

2. Conclusion of Contract

By clicking on the "Buy Tickets" field, the customer makes an offer to the respective organiser. The offer is deemed to have been accepted by the organiser only when ADITUS GmbH confirms receipt of payment visually or by e-mail. This concludes the contract between the customer and the organiser.

3. Personalised Tickets and Printout

Home tickets are delivered electronically by e-mail as a PDF file to the customer's e-mail address, and must be printed out via a laser or inkjet printer with a resolution of at least 300 DPI, in legible quality on white A4 paper, and in colour or black and white. Acrobat Reader must be used for the printout.  Home tickets are personalised and non-transferable, and are valid only for the holder whose surname and first name are printed on the ticket. Proof of the holder’s identity, e.g. an identity card, driving licence or passport, may be requested at the event's access control. Each home ticket is checked electronically for validity, and the customer is not authorised to misuse, reproduce or modify  home tickets. Duplication of any home ticket is a criminal offense and will be reported to the authorities. If copies of a home ticket appear, the original ticket is also invalid and no longer entitles admission to the event unless the customer is not at fault for the existence of the copies. The prinicple of first entry applies to access. Accordingly, only the printed ticket that is accepted first with its unique identification is valid. Subsequent reproduced or otherwise forged tickets are automatically invalidated upon acceptance of the first ticket.

4. Payment

Payment for home tickets is exclusively cashless and by credit card or prepayment. Each ticket is valid only when payment has been made in full. If for any reason payment is not made by credit card or prepayment, MAC-Hoffmann & Co GmbH reserves the right to block the corresponding passes for the event and refuse admission.

5. Withdrawal, Cancellation, Refund

The customer has no right of revocation (right of withdrawal) in accordance with § 18 para. 1 no. 10 of the Austrian Distance and Off-Premises Transactions Act (FAGG). Tickets purchased online via the ADITUS portal cannot be cancelled or returned by the customer. The organiser is free to cancel tickets purchased online as a gesture of goodwill. Any reimbursement of ticket prices in case of an event not taking place or in case of cancellation as a gesture of goodwill by the organiser shall be made exclusively via the organiser.

6. Cancellation of Event

If there is a complete or partial cancellation of an event, MAC-Hoffmann & Co GmbH must inform ADITUS GmbH immediately. If an event is cancelled, MAC-Hoffmann & Co GmbH is solely liable for reimbursement of the ticket price to the ticket purchaser. However, MAC-Hoffmann & Co GmbH is not liable if the event cannot take place due to force majeure or because of official orders. MAC-Hoffmann & Co GmbH reserves the right to make changes to the programme or the exhibition offer, provided that the changes are reasonable, minor and objectively justified. The ticket purchaser has no claim against MAC-Hoffmann & Co GmbH for reimbursement of the ticket price if there is a cancellation of the event. In case of cancellation, postponement or changes, neither ADITUS GmbH nor MAC-Hoffmann & Co GmbH will reimburse expenses (e.g. accommodation, travel costs, etc.).

7. Liability

ADITUS GmbH is not the organiser. ADITUS GmbH therefore accepts no liability for damage to property, personal injury or financial loss in connection with the organisation and execution of the event. ADITUS GmbH is not liable for damage caused by transmission errors, technical breakdowns, interruptions due to maintenance work or other disruptions for which ADITUS GmbH is not at fault. ADITUS GmbH shall be liable because of intent or gross negligence. ADITUS GmbH also shall be liable for the negligent breach of obligations whose fulfilment is essential for the proper execution of the contract, whose breach jeopardises the achievement of the purpose of the contract, and on whose compliance the customer regularly relies. In the latter case, however, ADITUS GmbH shall not be liable for damages that are not foreseeable and not typical for the contract. ADITUS GmbH shall not be liable for the slightly negligent breach of other obligations. The above exclusions and limitations of liability shall not apply in the event of culpable injury to life, body or health by ADITUS GmbH or its legal representatives or vicarious agents.

8. Data Security and Data Protection

MAC-Hoffmann & Co GmbH uses an encrypted transmission method (SSL) for the transfer of customer and payment data. This is intended in order to achieve the highest possible security standard. MAC-Hoffmann & Co GmbH takes the protection and confidentiality of its customers' personal data very seriously.

The storage and processing of customers' personal data is carried out to fulfil contractual obligations, such as the execution of ticket purchases, as well as all activities required for the operation and administration of ADITUS GmbH or the event organiser (Art 6 para 1 lit b GDPR). In addition, the processing of customers' personal data may be necessary for the purpose of fulfilling various legal obligations, for example in relation to bookkeeping or accounting.

If only mandatory information is provided in the course of the ticket purchase, this data will be used exclusively for processing the home ticketing. In addition to the right to information, the customer also has the right to rectification, deletion, restriction, objection and data portability with regard to their personal data. The user only has the right to deletion insofar as this is not opposed by legitimate interests on the part of ADITUS GmbH or the organiser and there are no statutory retention obligations. The customer also has the option of lodging a complaint with the data protection authority.

Google AdWords Conversion Tracking

This website uses the online advertising programme “Google AdWords” with conversion tracking. The conversion tracking cookie is set when a user clicks on an ad placed by Google. These cookies expire after 30 days and are not used for personal identification purposes. If the user visits certain pages of this website and the cookie has not yet expired, Google and MAC-Hoffman & Co GmbH can recognise that the user had clicked on the ad and was redirected to this page. Each Google AdWords customer receives a different cookie; cookies cannot be tracked via the websites of AdWords customers.  The information collected by the conversion cookie is used to create conversion statistics for MAC-Hoffmann & Co GmbH in an anonymized form.

MAC-Hoffmann & Co GmbH obtains the total number of the users who had clicked on their ad and were redirected to a page with a conversion tracking tag. MAC-Hoffmann & Co GmbH does not receive any information that can be used to identify users personally.  Users who do not want to participate in tracking can easily deactivate the Google conversion tracking cookie via the internet browser under “user” settings. These users will not be included in the conversion tracking statistics.

Conversion Tracking with Facebook’s Visitor Pixel

With your consent, we use the “visitor activity Pixel” from Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA (“Facebook”) within our website. With its help, we can track users’ actions after they have seen or clicked on a Facebook ad. This allows us to record the effectiveness of Facbook advertisements for statistical and market research purposes. The collected data is anonymous to us, which means we do not see the personal data of individual users.  However, this data is stored and processed by Facebook; this we will inform you about according to our level of knowledge.

Facebook can connect this data to your Facebook account and also use it for its own advertising purposes in accordance with Facebook's data usage policy https://www.facebook.com/about/privacy/.

You can enable Facebook and its partners to place advertisements on and outside of Facebook. A cookie may also be saved on your computer for these purposes.

This consent may only be given by users over the age of 13. If you are younger than this, we request that you ask your legal guardians for advice.

If you do not want Facebook to collect data about you via our website, you must log out of Facebook before visiting our website.

9. Applicable Law and Place of Jurisdiction

All agreements regarding online tickets and the use of the ADITUS GmbH home ticketing system are subject to Austrian law. The court with subject matter and local jurisdiction is the District Court Inner City of Vienna.
